General terms of use:
1. PURPOSE
The purpose of this document is to define the general terms of use and the privacy policy regarding the personal information provided by the users of Mercattel, free ads with photos (hereinafter Mercattel), property of Interwatts, Serveis Informātics i Telemātics SL, service manager and data maintenance.
The services and use of Mercattel are only authorized if the user accepts the following conditions, communications and notices.
Mercattel acts as mediator between users, and between users and visitors, who contact each other using the data provided by the advertiser through any mean of communication.
Mercattel reserves the right to modify texts or images that do not conform to its content policy.
Mercattel reserves the right to modify a text without previous notice to conform to Spanish and/or European legislation regarding personal data protection or information society and e-commerce services.
Please read carefully all the terms included in this document as the acceptance of all conditions and authorizations will allow you to register and use the service provided by Mercattel.
2. DEFINITIONS
- Website: Web portal of classified advertisements owned by Mercattel.
- User: Person responsible for the written content, for the link content and for the graphs or images of one or more ads placed in the website with an e-mail address validated by Mercattel.
- Visitor: Person who browses the website without having registered any ad.
- Payment by SMS message: System of payment based on SMS message sending using a mobile phone.
3. COPYRIGHT
This website and all of its contents (texts, images and any other material) are property of Mercattel and any third party who authorized their use to Mercattel.
All brands and logos property of Mercattel are protected by copyright and brands legislation. If you want to use any brand or logo property of Mercattel in your web page or any other printed media, send an e-mail to info@mercattel.com. 4. PERSONAL DATA PROTECTION
By virtue of Spanish Act 15/1999 of 13 of December on Personal Data Protection, all data provided by the user during the registration process will follow an automatic treatment in a personal data file. The files thus created will be property and responsibility of Mercattel. The user acknowledges that he/she provides their data willingly and expresses the acceptance of their automatic use by selecting the option when placing the ad, according to which he/she accepts registration to use the service.
Data provided by the user will solely be used to operate and manage the service provided by Mercattel, to solve any incident, to improve and offer personalized services and for statistical purposes.
The user's personal data are fully protected. Besides, the user has right to access, modify or cancel your data using the e-mail ad confirmation messages, selecting the option in the website main menu, sending a message to info@mercattel.com, or mailing such request to C. 5. TERMS OF ACCESS AND USE OF MERCATTEL
5.1. RIGHTS AND DUTIES.

The user shall not place any offensive advertisement regarding religion, racism, pornography or containing child abuse, selling of human organs or any other content attempting against human rights, fundamental rights or international public rights.
The user shall not disseminate illegal contents, false or ambiguous texts, contents violating copyright, patents, brands or any other right of any third party.
The user shall not link or insert electronic codes in texts or link to a site of his/her property or belonging to any third party that can cause any damage or that can be used to pirate computer systems or software.
The user shall use a correct language, as well as appropriate graphs and images in the advertisements.
The user shall not use any automatic application to place advertisements.
Mercattel authorizes the collection using any computer or automatic system of any content of the ads placed in Mercattel as long as the source is mentioned using a link to this website (www.mercattel.com).
The user has the right to access, modify or cancel his/her data at any time.

Mercattel has the obligation to watch over the correct use of the services provided and reserves the right to modify or cancel any content that does not conform to the terms of use or the privacy policy.
Mercattel has the obligation to respond to any possible doubt or claim presented by the users.
The data of the advertisements are hosted in a safe server. Mercattel guarantees a good optimization and management of these data.
This website and its services have an undefined validity. Without prejudice to the aforementioned, Mercattel has the right to unilaterally interrupt or cancel these services if the necessary condition to such cases shall appear.
5.2. LIABILITIES
Mercattel is solely responsible for its services and its website.
Mercattel holds no responsibility for the contents, actions, services or information offered by the users or any third party placing in this website their advertisements or any link to any third party.
Mercattel is responsible for the data registered by the users and undertakes to keep these data with absolute confidentiality and guarantees the users' right of access.
5.3. PRODUCTS AND SERVICES OF THIRD COMPANIES
The links placed by the users in their ads are under the responsibility of the users and any third party that by entering its website using this link is held responsible for the contents and has its own terms of use and legal notices. The user stops dealing with Mercattel and releases Mercattel from its responsibilities any time a user, clicking on a link placed in any classified advertisement or any other advertisement published in Mercattel, visits another website.
Mercattel does not bind itself into any contract with the user; Mercattel only enables communication between the user and a third party.
5.4. CHILDREN UNDER AGE
Children under age need their parents' or tutors' permission to use the services provided in this website. The parents or tutors shall be held responsible for the acts performed by the children under their responsibility using this website. The contents in the Personals and dating section are subject to paragraph 5.1. of this document and are only visible if expressly visited.
6. ADVERTISEMENT TRANSFER IN RSS CODE TO THIRD PARTIES
The advertisements with title and initial text in Mercattel RSS code are expressly lent to other portals for their use as long as they do not alter this code and, thus, when read the readers are directed to Mercattel website. This code is available at the foot of this page.
